Terms and Conditions for Five Star Tours Transportation, Tours, and Experiences
1. Reservation Agent Role
Five Star Tours acts solely as a reservation agent for transportation, tours, and experiences. We coordinate services on behalf of clients but do not operate or control all aspects of these services. Third-party providers may be involved in delivering certain components, and their terms may apply.
General Terms
2. Payments and Deposits
- A non-refundable deposit is required to confirm your reservation. Final payments are due 7 days before departure.
- All payments are non-refundable after receipt.
- Cancellations result in forfeiture of all monies paid.
- No refunds are provided once the final payment has been made.
Clients must provide detailed itineraries at least two weeks before departure. Prices are subject to change based on itinerary modifications.
5. Cross-Border Travel
For services involving cross-border travel:
- Five Star Tours is not responsible for delays, wait times, or regulations at border crossings, including immigration and Homeland Security policies.
- Clients are responsible for having proper documentation (e.g., passports, visas) for border crossings.
- We cannot guarantee expedited processing at border checkpoints.
Guest Conduct and Misconduct
6. Code of Conduct
To ensure the safety and enjoyment of all guests, the following behavior is expected:
- Treat all staff, drivers, and fellow passengers with respect.
- Follow instructions provided by the tour guide or driver at all times.
- Avoid disruptive behavior, including excessive noise, intoxication, or disorderly conduct.
Five Star Tours reserves the right to deny service, remove guests, or cancel a booking without refund in cases of misconduct, including but not limited to:
- Illegal activities.
- Vandalism or property damage.
- Physical or verbal abuse toward others.
- Failure to comply with safety protocols or legal regulations.
Health and Safety
8. Health Requirements
Guests must ensure they are in good health and able to participate in the tour activities. Please inform Five Star Tours in advance of any:
- Medical conditions, allergies, or dietary restrictions that may impact participation.
- Special accommodations or accessibility requirements.
- Guests exhibiting symptoms of contagious illnesses may be denied boarding or participation.
- It is the guest’s responsibility to comply with health and safety protocols, including wearing masks or providing proof of vaccination or negative test results if required.
In the event of a health emergency during a tour, Five Star Tours will assist in coordinating medical attention but is not financially responsible for medical costs or related expenses.
Additional Terms
11. Lost or Damaged Items
Five Star Tours is not liable for:
- Personal property left behind in vehicles.
- Damages to luggage or other belongings.
Clients should contact us immediately if they believe they have left an item in a vehicle. Items not claimed within 30 days will be discarded.
Guests are responsible for:
- Any damage to the vehicle caused by their party.
- Excessive spills, stains, or cleaning requirements beyond standard maintenance.
Cleaning fees: $250 per incident for minor cleanups, with additional charges for significant damages.
Five Star Tours is not liable for delays or cancellations caused by factors beyond our control, such as:
- Accidents, vehicle breakdowns, severe weather, or traffic conditions.
We reserve the right to allow reasonable time for vehicle repairs or replacements.
Any disputes arising from services provided by Five Star Tours will be resolved through confidential mediation in San Diego County, California. Clients agree to waive all claims for injury, loss, or damage to persons or property during service.
15. Legal Jurisdiction
The terms and conditions of Five Star Tours are governed by the laws of the State of California. Any legal disputes not resolved through mediation will be subject to County of San Diego, California courts.
16. Driver Hours and Regulations
- For motor coach services, driver hours adhere to Federal Department of Transportation regulations.
- Relief drivers may be required for extended trips, incurring additional costs.
While we strive to meet specific vehicle requests, we reserve the right to substitute a vehicle of equal or greater value when necessary.
18. Third-Party Provider Terms
Services provided by third parties (e.g., restaurants, hotels, attractions) are subject to their terms and conditions. Five Star Tours is not liable for issues related to third-party services.
19. Limitation of Liability
- Five Star Tours is not liable for any indirect, incidental, or consequential damages.
- Our liability is limited to the cost of services provided under the contract.
These terms represent the entire agreement between the client and Five Star Tours. Any changes must be in writing and signed by both parties.
